This includes incidents involving cars, trucks, motorcycles, buses, trains and trams. Cyclists who collide with a stationary motor vehicle or with an open or opening door of a motor vehicle can also lodge a claim with the TAC.

Impairment benefit
The impairment benefit doesn’t take fault into account, either, but you need to have an injury assessed at more than 10% permanent impairment to quality. As of 1 July 2025, the minimum impairment payment is $9,580 (11% permanent impairment) and the maximum is $437,830 (100% permanent impairment).
Common law damages
Finally, you may be entitled to common law compensation if you have a serious injury that was caused by another’s negligence. Common law damages compensate you for pain and suffering, as well as the loss of your past and future earnings. They are capped at $680,160 and $1,530,470 respectively, as of 1 July 2025.
Motor vehicle accident claims through the TAC are subject to a 12-month time limit. If you were injured whilst riding your bike in Victoria, that means you have just 1 year to lodge a claim for benefits. While the TAC has the discretion to accept claims made within 3 years of the date of an accident, you should lodge a claim as soon as possible.
Victoria’s Transport Accident Act 1986 allows additional time if the victim is a minor. A claim may be lodged within 3 years of the accident or before the victim turns 21, whichever is later.

Collisions between a bicycle and the opening of a motor vehicle’s door are covered by the TAC. In 2022, the legislation was modified to allow injured cyclists to pursue common law damages from passengers as well as drivers whose negligence leads to a dooring accident.
Accidents Due to Unsafe Roads
Potholes, cracks in the pavement and debris can make roads treacherous for cyclists. If you crash because a road or path was improperly maintained or repaired, you may be able to bring a claim against the property owner’s public liability insurance.
